These terms govern the use of Sinar Legal's website and outline the basis on which we provide commercial dispute resolution services to clients in Malaysia.

1. Definitions
In these Terms & Conditions, the following terms have the meanings set out below:
- "Agreement" — these Terms & Conditions together with any engagement letter or retainer agreement.
- "Services" — commercial dispute resolution services offered by Sinar Legal, including pre-litigation advisory, High Court litigation, and enforcement proceedings.
- "We / Us / Our" — Sinar Legal, operating from Level 6, Wisma Sinar, Jalan Raja Chulan, 50200 Kuala Lumpur.
- "User / You / Client" — any individual or entity that accesses our website or instructs us in connection with any matter.
- "Website" — the website accessible at https://sinarleg.pro.
- "Content" — all text, documents, articles, legal briefings, and other material published on the Website.
2. Acceptance of Terms
By accessing the Website or submitting an enquiry to Sinar Legal, you confirm that you:
- Are at least 18 years of age and have full legal capacity to enter this Agreement;
- Have read and understood these Terms & Conditions; and
- Agree to be bound by these Terms as they apply to your use of the Website and engagement of our Services.
If you are acting on behalf of a company or organisation, you represent that you have authority to bind that entity to this Agreement.
3. Service Description and Availability
Sinar Legal provides commercial dispute resolution services to businesses and individuals in Malaysia. Our practice areas include:
- Pre-litigation advisory — demand correspondence, negotiation strategy, mediation facilitation, and dispute mapping.
- High Court commercial litigation — conduct of proceedings before the Malaysian High Court and appellate courts.
- Enforcement services — execution of judgments, garnishment, and Mareva injunction applications.
The Website provides general information only. No solicitor-client relationship arises from browsing the Website or submitting an enquiry form unless and until a formal engagement letter is executed.
4. User Responsibilities
In using the Website and engaging our Services, you agree to:
- Provide accurate, complete, and current information in all communications with us;
- Notify us promptly of any material change to information previously provided;
- Not use the Website for any unlawful purpose or in any manner that infringes the rights of a third party;
- Not attempt to disrupt, compromise, or gain unauthorised access to our systems; and
- Cooperate reasonably with us in connection with any engaged matter, including provision of documents and timely instructions.
5. Intellectual Property
All Content on this Website — including legal briefings, articles, methodology descriptions, and design elements — remains the exclusive intellectual property of Sinar Legal or its licensors.
You are granted a limited, non-exclusive, non-transferable licence to access the Website for your own lawful informational use. You may not:
- Reproduce, distribute, or commercialise any Content without prior written consent;
- Remove or obscure any copyright, trademark, or proprietary notices; or
- Use any Content to create derivative works for public or commercial distribution.
Work product and legal documents prepared on your behalf under a retainer remain subject to the terms of the applicable engagement letter.
6. Fees and Payment
Professional fees for legal services are governed by the Solicitors' Remuneration Order 2005 and the terms of your engagement letter. The following general principles apply:
- Fee estimates are indicative and subject to change based on complexity, scope, and court developments.
- Fees are denominated and payable in Malaysian Ringgit (MYR) unless otherwise agreed in writing.
- Disbursements (court filing fees, process server charges, etc.) are billed separately and are the client's responsibility.
- Invoices are payable within 14 days of issue unless alternative payment terms are agreed in writing.
- Overdue balances may attract interest at 8% per annum, compounded monthly.
7. Confidentiality
We maintain strict professional confidentiality with respect to all client information, consistent with our obligations under the Legal Profession Act 1976 and the Rules of the Malaysian Bar. Client information will not be disclosed to third parties except:
- With your prior written consent;
- As required by law or court order; or
- To co-counsel, experts, or other professional advisers instructed in connection with your matter.
8. Disclaimers
Content published on the Website is provided for general informational purposes only and does not constitute legal advice. Sinar Legal makes no representation that the Website will be uninterrupted, error-free, or free of harmful components.
No outcome guarantee
Past results described in our materials do not guarantee or predict the outcome of any future matter. Legal proceedings are inherently uncertain, and no assurance of a specific result is given or implied.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Sinar Legal's aggregate liability to any client arising from professional services shall not exceed the fees paid for the specific matter giving rise to the claim. We shall not be liable for:
- Any indirect, consequential, special, or punitive loss;
- Loss of profit, revenue, contracts, or anticipated savings;
- Loss arising from reliance on Website Content without a formal retainer; or
- Acts or omissions of third parties including courts, enforcement authorities, or opposing counsel.
Nothing in this clause limits liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded.
10. Indemnification
You agree to indemnify and hold harmless Sinar Legal and its solicitors from any claims, losses, costs (including solicitor-client costs), and expenses arising from: (a) your breach of these Terms; (b) any inaccurate or misleading information provided to us; or (c) your violation of any third-party rights in connection with your use of our Services.
11. Termination
Either party may terminate a retainer on reasonable written notice, subject to the terms of the engagement letter. Sinar Legal reserves the right to cease acting where:
- A conflict of interest arises that cannot be managed;
- Fees remain outstanding beyond agreed payment terms;
- You have provided materially inaccurate information; or
- Continuation would breach professional conduct rules.
Upon termination, all outstanding fees become immediately payable, and any documents belonging to you will be transferred as directed subject to lien rights.
12. Dispute Resolution and Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from the Website or professional services shall be subject to the following process:
- 1Informal resolution: Parties shall first attempt to resolve the dispute amicably by written communication within 14 days of a complaint being raised.
- 2Bar Council fee dispute mechanism: Fee disputes may be referred to the Disciplinary Committee of the Malaysian Bar pursuant to the Legal Profession Act 1976.
- 3Litigation: Unresolved disputes shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
13. General Provisions
- Entire Agreement: These Terms, together with any applicable engagement letter, constitute the entire agreement between the parties regarding its subject matter.
- Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
- No Waiver: Failure to enforce any provision of these Terms does not waive the right to enforce it in the future.
- Assignment: You may not assign rights or obligations under these Terms without our prior written consent. We may assign in the context of a firm restructuring.
- Amendments: We may update these Terms from time to time. Changes take effect when posted on the Website. Continued use constitutes acceptance.
