Commercial Disputes Resolved with Clarity

Challenge

A construction subcontractor had completed work under a fixed-price contract but the main contractor disputed RM 1.4 million in claimed variations, refusing payment without formal justification.

Solution

Pre-litigation advisory identified strong documentary support for the variation claims. After a demand letter produced no response, High Court proceedings were commenced and an application for summary judgment was pursued.

Result

Summary judgment was obtained for the full amount plus costs within nine months of filing. No trial was required. Full payment followed within six weeks of the order.

Challenge

A professional services firm held a judgment for RM 780,000 against a former client. The debtor had transferred known assets and was not cooperating with enforcement. The judgment was fifteen months old and previous counsel had made no progress.

Solution

Judgment debtor examination was obtained to compel disclosure of financial position. This revealed an active receivable from a third party. A garnishee order was applied for against the third party before the funds were disbursed.

Result

Approximately RM 620,000 was recovered through the garnishee order within five months of engagement. Remaining balance subject to ongoing enforcement steps.
